ParkWiFi reserves the right to change this Policy at any time by posting changes online on the ParkWiFi Web site at least 30 (thirty) days in advance of the effective date of any changes. You are responsible for regularly reviewing information posted online in the "ParkWiFi Pricing" area to obtain timely notice of such changes. 1.    ONLINE FORMS

On our feedback form, contact form, and registration form we ask for contact information such as name and e-mail address so that we may respond to your questions or comments if necessary. The information that you provide may be classified as private by law. You are not legally required to provide this information, but if you do not supply this information on a contact or feedback form, we will be unable to contact you. Contact information missing from a registration form may mean that your registration will be incomplete and may not be able to be processed.

The information you provide will be available to ParkWiFi staff to allow them to perform their work-related duties.

SERVER LOGS

We store only the following information:

• the IP address from which you access the Internet
• the date and time you access the Internet
• the browser you use to access the Internet

3.    COLLECTION AND USE OF INFORMATION

ParkWiFi customers are asked to provide certain information when they sign up for our Services such as name, address, telephone number, billing information (such as a credit card number), and the type of personal computer being used to access the Services. The personal information collected from customers during the registration process is used to manage each Customer's account (such as billing and collections).

In order to better understand our customers, ParkWiFi collects consumer data such as ZIP code, demographics and other publicly available information from third parties. ParkWiFi uses this data to provide product and service offers. We use data in aggregate to develop products and offers to better serve our customers.

ParkWiFi may share non-identifying personal information with select affiliates in order to provide ParkWiFi services to our customers. ParkWiFi does not share identifying information (like name and address) with affiliates for their use in delivering product and service offers to customers. Affiliates will not be allowed to use any information provided in serving our customers to be sold, rented, or given to any other company. Affiliates are not allowed to use ParkWiFi data for any other purpose other than ParkWiFi-approved programs designed to better serve ParkWiFi customers.

In instances where ParkWiFi and an affiliate jointly promote the Services, ParkWiFi may provide the affiliate certain personal information, as a result of the joint promotion. In this instance, the information may not be used by the affiliate for any other purpose. ParkWiFi may also generate aggregate profiles from information provided during registration (such as the total number, but not the names, of customers). We may use this aggregated and non-identifying information to sell advertisements that appear on the Services.

We use registration information to contact you in a variety of ways. We may send you offers through e-mail, phone or regular mail of ParkWiFi products and services or offers. Customers will receive administrative e-mails from ParkWiFi.

4.    ONLINE SHOPPING

At some Web sites, you can purchase products and services or register to receive materials, such as a catalog or new product and service updates. In many cases, you may be asked to provide contact information, such as your name, address, e-mail address, phone number, and credit/debit card information. If you complete an order for someone else, such as an online gift order sent directly to a recipient, you may be asked to provide information about the recipient, such as the recipient's name, address, and phone number. ParkWiFi has no control over third-party Web sites and their use of any personal information you provide when placing such an order. Please exercise care when doing so.

Any information that you disclose in public areas on the Internet may become public information. You should exercise caution when deciding to disclose personal information in these areas.

6.    PARKWIFI'S COMMITMENT TO DATA SECURITY

ParkWiFi has security measures in place to protect the loss, misuse, and alteration of the information under our control. While we make every effort to ensure the integrity and security of our network and systems, we cannot and do not guarantee that our security measures will prevent third-party "hackers" from illegally obtaining this information. We will never sell your information to a third party.

7.    COOKIES

ParkWiFi, it resellers, distributors, service providers, and/or suppliers do not warrant that access to or use of ParkWiFi will be uninterrupted or error free; that customers will be able to access ParkWiFi at any time and in any geographic area; or that ParkWiFi software, services, or related equipment meet any particular criteria of performance, quality, or privacy protection.

PARKWIFI, IT RESELLERS, DISTRIBUTORS, SERVICE PROVIDERS, AND/OR SUPPLIERS, HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO PARKWIFI AND ALL RELATED SERVICES, SOFTWARE, AND EQUIPMENT, INCLUDING, WITHOUT LIMITATION, DUTIES, OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, OF LACK OF VIRUSES, OF SECURITY OF INFORMATION, OF LACK OF NEGLIGENCE, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, TITLE, AND NON-INFRINGEMENT. ParkWiFi's liability to you for breach of this Agreement is limited to the amount actually paid by you to ParkWiFi for access to and use of ParkWiFi. You hereby release ParkWiFi from any and all obligations, liabilities, and claims in excess of this limitation. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. IF YOU ARE DISSATISFIED WITH ANY PORTION OF PARKWIFI OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO NOT SIGN UP FOR A PARKWIFI ACCOUNT OR TO TERMINATE YOUR PARKWIFI ACCOUNT.
